2. Legal basis for processing personal data

2.1. The legal basis for the processing of your personal data is the fact that this processing is necessary for:

• 2.1.1. the performance of a contract between you and the controller or for the implementation of measures by the controller prior to the conclusion of such a contract within the meaning of Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the "Regulation");
• 2.1.2. compliance with the legal obligations to which the controller is subject, within the meaning of Article 6(1)(c) of the Regulation, specifically, in particular, compliance with the obligations imposed on the controller by generally binding legal regulations, in particular Act No. 235/2004 Coll., on Value Added Tax, as amended, Act No. 586/1992 Coll., on Income Taxes, as amended, and Act No. 563/1991 Coll., on Accounting, as amended.

3. Purpose of processing personal data

3.1. The purpose of processing your personal data is the performance of the contract between you and the controller according to the Proweb Service Terms and Conditions (available on the website www.proweb.cz/en/terms-of-service), including the settlement of rights from liability for defects, or the implementation of measures by the controller prior to the conclusion of such a contract, and further the fulfillment of related public law obligations by the controller.

3.2. There is no automatic individual decision-making by the controller within the meaning of Article 22 of the Regulation.

4. Period for which personal data will be stored

4.1. Your personal data will be processed for the duration of the effects of the rights and obligations arising from the contract, and further for the period necessary for archiving purposes according to the relevant generally binding legal regulations, but no longer than for the period determined by generally binding legal regulations.

5. Other recipients of personal data

5.1. Other recipients of your personal data will be persons forming a group with the controller, persons providing technical activities, providers of AI models (e.g., OpenAI Ireland Ltd., Google Cloud EMEA, and others) and content generation tools (who may process entered data as part of content generation based on your instructions), or organizational activities for the controller in accordance with the controller's instructions, persons providing accounting services for the controller in accordance with the controller's instructions (processors of personal data), domain name registrars (e.g., CZ.NIC, z.s.p.o., and others), including operators of central domain name registries (other controllers of personal data), and payment gateway and accounting system providers.

5.2. Recipients of your personal data for the fulfillment of obligations arising from legal regulations may further be financial administration authorities or other relevant authorities in cases where generally binding legal regulations so impose on the controller.

5.3. The controller will not transfer personal data to a third country (outside the EU) or an international organization, with the exception of necessary data related to the use of AI model services and cloud storage (e.g., OpenAI, Google, and others). Transfers to the USA take place in accordance with the European Commission's decision on an adequate level of protection (EU-U.S. Data Privacy Framework) or on the basis of standard contractual clauses on data protection.

6. Rights of the data subject

6.1. Under the conditions set out in the Regulation, you have the right to request access to your personal data from the controller, the right to rectification or erasure of your personal data, or restriction of its processing, the right to object to the processing of your personal data, and the right to the portability of your personal data.

6.2. If you believe that the processing of your personal data has violated or is violating the Regulation, you have, among other things, the right to lodge a complaint with a supervisory authority.

6.3. You are not obliged to provide personal data. The provision of your personal data is a necessary requirement for the conclusion and performance of the contract, and without the provision of your personal data, it is not possible to conclude the contract or for the controller to perform it.

7.1. The controller uses cookies on the website to ensure the functionality of the system (necessary cookies), analyze traffic, and improve AI models.
